SB-313 requirements for merchants

  1. Merchants must display the terms of sale, including recurring billing or automatic renewal terms, in a clear and conspicuous manner before the subscription is paid for by the customer. If the offer includes a free trial or promotional price, the price that will be charged after the end of that period must also be clear and conspicuous.
  2. Merchants can’t charge a customer’s account for an automatic renewal or continuous service without first obtaining affirmative consent from the customer.
  3. Merchants must provide customers with clear information on how to cancel. If a free trial period is involved, this information must be provided before the end of the trial period, and customers must be allowed to cancel before the end of the trial.
  4. Merchants must provide a toll-free telephone number, electronic mail address, a postal address if the seller directly bills the customer, or another cost-effective, timely, and easy-to-use mechanism for service/subscription cancellation.
  5. A customer who signs up for a subscription online must also be able to cancel that subscription online.
  6. If the terms of the agreement change, the customer must be provided with a notice of the changes and instructions on how to cancel their subscription.
